1. Who we are

This website is operated by JJ Rewards Pty Ltd T/A Supernova Brands, registration number 2014 / 184202 / 07, VAT number 4470269996, trading as arc + hue, South Africa. "We", "us" and "our" refer to arc + hue. "You" refers to the person visiting this site or placing an order.

By visiting our site or placing an order, you agree to these terms.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By ordering you confirm that the payment details you provide are yours and that you are authorised to use them.

3. Products and descriptions

We describe our products as accurately as we can, including dimensions, materials, run times and lumen output. Screens vary, so colours may appear slightly different from the actual product. Minor variations in finish are a feature of manufacturing, not a defect.

We reserve the right to change or discontinue products at any time.

4. Pricing

All prices are in South African Rand and include VAT at the prevailing rate. Delivery is charged separately unless your order qualifies for free delivery.

We take care with pricing, but if an item is listed at an obviously incorrect price because of a technical or human error, we are not obliged to supply it at that price. We will contact you, offer the item at the correct price, and refund you in full if you would rather not proceed.

5. Orders and acceptance

Your order is an offer to buy. A confirmation email acknowledges receipt of your order — it is not acceptance. The contract comes into existence when we dispatch your order.

We may decline or cancel an order where:

• The item is out of stock
• We cannot verify the payment
• The delivery address falls outside our service area
• We suspect fraudulent activity
• The order was placed on an incorrectly displayed price

If we cancel an order you have paid for, we refund you in full.

6. Payment

We accept [Visa, Mastercard, instant EFT. Payment is processed by our payment providers; we do not store your card details.

Orders are processed once payment has cleared and is reflected in our account. Proof of payment is not payment confirmation, and we reserve the right to withhold release or dispatch of goods until payment has been verified.

7. Delivery

Delivery timeframes are estimates in working days, not guarantees. Risk in the goods passes to you on delivery. Ownership passes once we have received payment in full.

8. Returns

Returns and refunds are governed by our [Return and Refund Policy], which forms part of these terms and does not limit your rights under the CPA or ECTA.

9. Intellectual property

All content on this site — the arc + hue name and logo, product designs, photography, copy, and the site itself — belongs to us or our licensors and is protected by South African and international law. You may not reproduce, distribute or use it commercially without our written permission.

10. Your use of this site

You agree not to use this site for any unlawful purpose, not to interfere with its operation or security, and not to extract data from it by automated means without our permission.

If you create an account, you are responsible for keeping your password secure and for activity under your account. Tell us immediately if you suspect unauthorised use.

11. Reviews and submissions

If you post a review or send us photographs, you confirm the content is yours to share and you grant us a non-exclusive, royalty-free licence to use it in our marketing. We may remove content that is unlawful, misleading or offensive.

12. Privacy

We process your personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy.

13. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be limited under the CPA.

Subject to that, we are not liable for indirect or consequential loss, including loss of profit or loss of use, arising from your purchase. Our total liability for any order is limited to the amount you paid for it.

14. Circumstances beyond our control

We are not liable for delays or failures caused by events outside our reasonable control, including adverse weather, road closures, load shedding, labour disruption, courier failures, or acts of government.

15. Third-party links

Our site may link to third-party sites. We do not control them and are not responsible for their content or practices.

16. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.

17. Governing law

These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction.
